1、 工程施工委托协议书 (6000字)工程施工委托协议书 工程名称：武鸣县2011年第一批重点小型病险水库除险加固中央专 项补助资金项目IV标段（定罗水库） 委托方：江苏禹王水利建设工程有限公司 受托方： 2012年 月 日 工程施工委托协议书 委托方（以下简称甲方）：江苏禹王水利建设工程有限公司 受托方（以下简称乙方）： 江苏禹王水利建设工程有限公司（以下称称甲方）于2 0 1 1年1 2月5日与业主武鸣县水利工程管理站签订了武鸣县2 0 1 1年第一批重点小型病险水库除险加固中央专项补助资金项目IV标段（定罗水库）工程施工承包合同（以下简称主合同）。现甲方委托 （以下简称乙方）负责施工，经甲
2、乙双方协商达成如下协议： 一、委托施工内容： 江苏禹王水利建设工程有限公司与业主武鸣县水利工程管理站签订武鸣县2 0 1 1年第一批重点小型病险水库除险加固中央专项补助资金项目IV标段（定罗水库）施王承包合同的全部内容。 二、甲方责任、权利和义务 1、与业主签订合同（包括随后可能签订的补充合同）。 2、组建工程项目经理部。项目经理部作为甲方的派出机构，到施工现场具体履行甲方职责，对工程进度、质量、安全及资金等进行监督管理。 3、组织公司职能部门定期或不定期对工程进行检查，对发现的问题提出整改措施，并督促乙方实施。 4、审核施工组织设计和有关施工报表、报告以及工程结算、竣工资料。 5、做好施工中
3、的协调工作，尽量为乙方创造良好的施工环境。但由于业主或监理以及遇不可抗为的自然灾害等原因导致工程窝工、停工和延期，甲方不负任何责任，乙方应予理解并承担由此可能带来的成本增加的风险。 6、甲方享有因乙方原因造成的经济和法律纠纷时停止支付工程款的权利。 7、项目经理部印章由乙方管理，甲方监督使用。 三、乙方责任、权利与义务 1、乙方接受甲方委托施工本工程，必须履行主合同包括随后可能签订的补充合同的有关条款，按主合同的规定全面完成各项承包工作，并承担主合同规定的承包人的全部义务和责任，负责协调业主与监理部门关系。 2、负责工程施工、竣工和保修的全部工作。包括（但不限于）施工工期、施工质量、施工安全、
4、文明施工、竣工资料及验收等全部工作，并承担由此发生的全部费用。 3、严格按施工规程、规范或国家有关法规的要求以及甲方的质量、安全管理要求进行施工，按主合同要求完成工程施工任务。若因乙方管理不当，出现质量、安全、工期及其他与本工程相关的问题而受到业主或国家相关部门的处罚时，则由乙方承担责任并负责由此造成的经济损失。施工过程及质保期内发生质量问题造成返工的，乙方须承担返工责任及费用。若发生安全事故，由乙方承担责任并负责理赔。 4、负责雇用除甲方派出的管理人员以外的施工所需的全部岗位人员，并将雇用名单及相应岗位安排书面报告甲方。乙方应及时付清其雇用人员的工资和采购材料费及机械设备租赁费用。每月1 0
5、日前向甲方提交上月的债权债务一览表和所雇用人员工资发放表。以上表格必须由乙方、债权人、乙方所雇用人员签字确认，甲方有监督权。乙方与第三方的债权债务由乙方自行解决，甲方不承担任何责任。5、负责为本工程相关人员办理建筑意外伤害保险，保险发票及有关协议交甲方保管。 6、未经甲方许可不得直接从业主处领取工程款。如有业主代扣款项，乙方须于该事项发生后2天内告知甲方并提交相关凭证。否则，甲方对乙方处以2倍代扣款额的罚款。 7、乙方有义务按甲方要求，配合甲方的质量、安全、环境保护等体系认证工作。 8、乙方不得将工程以任何方式分包或转包给第三方。 9、乙方保证不拖欠民工工资，否则，甲方有权从工程款中直接支付工
6、资给民工及相关材料费。 1 0、乙方不得使用甲方项目章用于担保、购销货物等活动，否则，甲方有权追究乙方的相关法律责任。 四、有关费用事项：乙方必须在甲方与业主合同签订后拾个工作日内完成以下工作：向甲方交纳合同履约担保金（如果乙方要申请预付款同样要交纳预付款履约担保）、到劳动部门交纳农民工工资保障金。 1、甲方按与业主结算总价的叁收取工程管理费。 2、施工期间及完工后一个月，甲方按以下标准向乙方收取。 (1)公司委派管理人员1名：5000元月人。广西区域的交通费、通讯费等由乙方另行据实支付。来往公司总部（江苏）的交通费采取协商包干使用方法，按合同期内3次往返，每次4000元，合计12000无包干
7、。 (2)根据实际需要，安排驻项曰部工地现场人员。项目经理，工资按5000元月人发放；其余人员按4000元月人发放。甲方派驻项目部人员的交通、通讯费及其他费用由乙方另行据实支付。 (3)甲方人员为本项目应付检查等的全部费用均由乙方负责。 4、每次支付工程款，乙方交完营业税，企业所得税及资源税后，甲方并扣除3管理费用后余款及时拨付给乙方作为施工费用。农民工工资发放表、管理人员工资发放表)才能领取工程款。 五、特别约定 为维护本公司在广西的良好信誉，若因乙方管理不当，导致工期严重滞后或工程质量、工程安全出现重大问题，导致业主或市级水利主管部门通报，通报一次罚乙方1万元。导致水利厅通报，通报一次罚乙
