1、塑钢门窗制作安装合同发包方（甲方）：郑州群缘房地产开发有限公司 承包方（乙方）： 依照中华人民共和国合同法和建筑安装工程承包合同条例和房屋建筑工程质量保修办法及其他有关法律、行政法规，遵循平等、自愿、公平和诚实信用的原则，双方就本工程施工事项协商一致，订立本合同。第1条 工程概况、工期、承包方式、合同款价1.1工程概况工程名称： 丽珠水岸1#楼营业房玻璃幕墙、门联窗、塑钢窗制作安装 工程地址： 新郑市人民路南侧、西岸杰座西侧 工程内容：乙方根据甲方提供的图纸及甲方定做要求进行玻璃幕墙、门联窗、塑钢窗制作安装。塑钢窗采用80双色共挤塑钢窗，5+9+5中空玻璃制作，安装衬钢厚度不低于1.0mm，标
2、准配件；玻璃幕墙用料为银白色140系列幕墙专用料，结构为全隐框式玻璃幕墙，铝型主材规格为140653.5，玻璃为5白玻+镀膜；门联窗采用彩铝门窗用料制作安装。施工工序严格按照设计图纸及有关施工规范进行施工。1.2工期开工日期： 2014年4月20日 竣工日期： 2014年5月10日 保修期： 壹 年，自塑钢门窗工程验收合格之日起计算。1.3承包方式承包方式：包工包料、包制作安装、运输、包质量、包工期及保修。1.4合同价款塑钢门窗数量： 约450 平方米（按图纸及甲方要求按门窗实际净尺寸计算门窗面积按实结算）塑钢窗综合价格为190元/，塑钢窗合同价款为85500元；玻璃幕墙面积为103平方米，彩
3、铝门联窗面积为49平方米，玻璃幕墙和彩铝门联窗综合单价均为390元/，玻璃幕墙及彩铝合同价款为59280元（含型材、衬钢、玻璃、发泡剂、密封胶、配件、施工、检测、运输等上下费用）。以上合同价款不含税金，检测费用及资料费用。合同总价款为：￥ 144780元，大写：壹拾肆万肆仟柒佰捌拾元（暂估，最终结算价以实际发生量计算）。三、付款方式1、结算方式：按图纸及甲方要求按门窗实际净尺寸计算门窗面积， 2、乙方工程完成塑钢窗经验收合格付塑钢窗款的80%，玻璃幕墙及彩铝门联窗完成经验收合格付玻璃幕墙及彩铝窗的80%，全部工程结束经验收合格后付款95%。预留5%质量保证金，保修期为一年。保修期满无质量问题一
4、个月内返还全部质量保证金。由于甲方未按合同给付工程款造成的停工及相关损失由甲方负责并承担相关连带赔偿责任.四、制作质量标准： 塑钢门窗及门联窗制作应符合：建筑装饰装修工程质量验收规范（GB50210）、住宅装饰装修工程施工规范（GB50237）、塑料门窗安装及验收规程（DBJ13-35）。 主要材料及制作安装质量必须达到国家标准要求，门窗并按国标生产安装验收。乙方应按照国家颁发的行业标准JGJ103-2008塑钢门窗工程技术规程及相关规范标准和图纸要求加工生产，对产品确属生产质量问题的，乙方应承担相应系列损失及责任。 五、制作责任事项： 1甲方权利及义务 （1）合同签订后 天内与乙方确认门窗加
5、工生产图纸，并向乙方进行现场交底。 （2）甲方与乙方共同负责监督、检查工程制作质量、进度、隐蔽工程制作的验收，办理设计变更、签证及验收手续，负责协调现场各车间之间的协作与配合工作。 （4）协调车间向乙方提供成品及工具堆放场地。 （5）甲方按合同规定组织工程制作验收，并按合同的期限做好制作竣工结算。 （6）甲方按合同的约定及时支付乙方制作费，该制作费由乙方按照甲方管理规定填写表格并指定专人领取或支付到乙方指定的专用账户，除此之外任何人不得以不正当理由领取扣压该制作费（因乙方原因造成的违规处罚款除外）。 2乙方的权利及义务 （1）乙方与甲方技术部或质检部共同负责监督、检查工程制作质量、进度、隐蔽工
6、程制作的验收，办理设计变更、签证及验收手续，负责协调单位各车间之间的协作与配合工作。甲方按规范要求负责随机抽检乙方生产的成品门窗至检测部门进行性能检测。乙方必须服从甲方技术部和生产部的管理要求和技术要求，如乙方有疑问或建议必须经甲方相关部门核实和同意。 （2）乙方负责按工程制作图纸预算生产所需材料及辅材明细，由甲方核实确认。 （3）乙方负责生产所需所有设备（加工生产主要设备除外），以及车间内所有的垂直运输和装卸等。 （4）乙方负责在甲方的组织下及时与工地办理土建洞口交接工作及参照其测量的洞口尺寸做好工程制作尺寸工作，并给甲方提供工程制作的图纸、工程制作材料和辅材料明细清单，及时与甲方技术部沟通
7、确认，保证门窗制作的准确性，并准确的在门窗制作图纸上标注明其位置及尺寸，保证满足安装要求。制作图纸必须由甲方技术部核实其部门负责人签字确认，制作图纸为一式三份，原件为技术部存档，生产部一份，制作班组一份。 （6）乙方指派驻单位代表，负责合同履行，按要求组织制作，保质、保量、按期完成制作任务，处理负责制作过程中的各项事宜。 （7）乙方按甲方要求进场制作，并提前组织好成品的运输、保护等工作，服从总承包单位的全面管理。 （8）按制作安全规范的规定，采取制作安全保卫等技术措施，确保现场制作工人及第三者安全，负责现场设施、设备、所有生产所需的材料及成品的保护工作。并无条件的服从甲方车间的卫生管理制度，如
8、不执行甲方之管理规定的，甲方有权对乙方做出处罚。（处罚标准按照企业的奖罚制度和企业的考核制度为准） （9）乙方必须接受甲方工程部（或质检部）的监督和管理，并服从甲方单位对工程制作总进度计划安排与施工协调。如乙方违规或不服从甲方管理，甲方有权停止乙方的制作任务，严重的可单方终止合同，并扣除乙方已经完成工程的40%作为处罚。 （10）乙方要严格按甲方审批后的加工图纸和国家现行的制作及技术验收规范进行制作，确保制作工程质量和合同工期。如乙方原因造成的质量损失和延误工期，甲方由绝对权力对乙方做出相应处罚，乙方必须无任何争议的执行。 （11）乙方必须参加工程制作验收，工程制作竣工验收合格后，应按甲方要求
9、及时办理制作竣工资料的移交，编制工程制作结算，并及时交与甲方生产部和质检部及财务、仓库核对和签字确认。 （12）乙方工程制作日完工后及时清运垃圾、清理车间和设备，做到工完场清，垃圾堆放到指定地点。 （13）制作期间，乙方因制作工程被甲方单位及政府职能部门处罚的，乙方自行负担该项罚款。 （9）乙方负责所做的成品保护及中间验收、竣工验收。 （10）乙方对工程制作过程中的生产安全工作负全部责任，与甲方无任何关系。甲方有权强制乙方为参加生产人员投意外伤害保险，每人保额不得低于4万元，乙方必须在合同签订后5个工作日内将保险单提供甲方核准，如乙方不按照甲方之规定要求投保，甲方有权单方撤销合同。 （11）如
10、乙方不能按质量和安全要求组织生产，甲方有权要求乙方退场，由甲方另行发包该工程制作。因后续制作生产产生的多余费用将由乙方承担，甲方有权拒绝乙方前期制作费的支付，待后续者将剩余制作工程完成结算清后，再于乙方结算，并扣除乙方合同中工程量10%的违约金。 六、安全及其它责任1、乙方在承包制作塑钢门窗全生产过程中，应严格遵守国家、省、市关于安全生产的法令、法规，做好对生产工人的安全教育和管理责任，落实安全责任的签约及劳动保护措施，并要求生产车间设备操作定员、定岗、安全文明施工。2、乙方应服从甲方对生产的安全、质量、进度等的全面检查和管理，对违反安全规定和影响产品质量、进度的情况，甲方可责令乙方立即改正。
