1、 编号： 工程施工分包合同【公司统一文本】分包工程： 施工地址： 发 包 方： 分 包 方： 55土方回填及场地平整工程承包合同发包方：宁波创新建设有限公司沈阳分公司（以下简称甲方）分包方： （以下简称乙方）根据中华人民共和国合同法、中华人民共和国建筑法及其他相关法律、法规之规定，甲乙双方在平等、自愿、协商一致的基础上，就沈阳港基.双水岸别墅区域回填土及场地平整工程施工事宜，达成如下条款，共同遵守。第一条 分包内容：1.1工程名称：沈阳港基.双水岸别墅区域回填土及场地平整工程 1.2工程地点：沈阳市浑南新区白塔堡 1.3承包范围：别墅区域回填土及场地平整工程 场地的标高控制； 别墅区域土方回填

2、及场地整平：场地回填土每500mm厚压实一次； 场地整平误差控制在100mm以内。 场地内临时施工道路； 施工机械； 土方来源； 安全文明施工； 1.4质量标准：一次验收合格率100%，并达合格标准。 1.5合同工期： 整个工期不能超过10天第二条 合同价款2.1本工程根据承包范围工作内容按综合单价包干，工程量按现场实际测得的网格图计算实际发生的回填土方立数及场地平整面积，。综合单价包括承包范围内施工过程中发生的所有费用。工程范围内不可预见障碍物所发生的费用包含在综合单价包干范围内，不再另行核算。2.2回填土及场地平整综合单价为 13 元/m3 （此综合单价为一次性包干价，已包含完成所列内容的

3、一切费用），工程量暂估 立方米，暂定总价 万元，大写人民币 元。2.3本价格包括承包人按发包方的要求完成别墅区域回填土及场地平整工程所需人工费、材料费、机械费、措施费及其调差、机械进出场费、渣土费、市容清洁费、排降水、利润、管理费、扰民费、税金等施工过程中发生的所有费用。2.4本合同价款在本合同签订后，不因市场的物价变动、政府文件或定额变更而调整，也不因施工人在报价时审阅甲方提供的文件、图纸资料失误而调整。 第三条 技术要求及技术规范1、 质量标准：按国家、省、市相关施工技术、质量及安全等相关标准和规范执行，并一次验收合格率100%。2、 满足甲方工期要求。3、 乙方回填土施工必须符合国家及省

4、、市部门的法律法规。4、 乙方全权负责完成别墅区域回填土及场地平整工程完工后，通过甲方组织的竣工验收工作，并向甲方提交相应的资料。 5、乙方回填土及场地整平施工期间必须采取消音降噪措施，不能影响附近居民的正常生活（此部分费用已包含在综合价中，结算时不作调整）。第四条 工程施工1、进度计划：1.1 乙方应在开工前2日内，将施工方案和工程进度计划提交甲方，甲方应在2日内予以确认或提出修改意见，逾期不确认也不提出书面意见的，视为同意。1.2 乙方必须按甲方确认的进度计划组织施工，接受甲方对进度的检查、监督。工程实际进度与经确认的进度计划不符时，乙方应按甲方的要求提出改进措施，经甲方确认后执行。2、工

5、程工期：n 乙方应当按甲方约定的开工日期开工。乙方不能按时开工，应当以书面形式向甲方提出延期开工的理由和要求，获得甲方书面批准后方可延期。n 甲方有权延迟或提前开工，开工日期以发包人正式书面通知日期为准，总工期不变。n 甲方认为确有必要暂停施工时，应当以书面形式要求乙方暂停施工。乙方应当按甲方要求停止施工，并妥善保护已完工程。因甲方原因造成停工的，工期顺延；因乙方原因造成停工的，由乙方承担发生费用，工期不予顺延。n 因以下原因造成工期延误，经甲方确认，工期应当顺延：u 甲方未能按本合同的约定提供相应的图纸或开工条件；u 本合同约定的不可抗力；u 甲方书面同意工期顺延的其他情况。n 乙方在本条2

6、.4款情况发生后7天内，就延误的工期以书面形式向甲方提出报告。甲方在收到报告后7天内予以确认，逾期不予确认也不提出异议的，视为同意顺延工期。n 乙方必须按照本合同约定的竣工日期或甲方同意顺延的工期竣工。因乙方原因不能按照本合同约定的竣工日期或甲方同意顺延的工期竣工的，乙方承担违约责任。n 承包人向发包人承诺按照合同约定进行施工、完工。3、安全施工：3.1 乙方应遵守工程建设安全生产有关管理规定，严格按安全标准组织施工，并随时接受行业安全检查人员依法实施的监督检查，采取必要的安全防护措施，消除事故隐患。由于乙方安全措施不力造成事故的责任和因此发生的费用，由乙方承担。3.2 乙方应对其在施工场地的

7、工作人员进行安全教育，甲方不得要求乙方违反安全管理的规定进行施工。3.3 发生重大安全事故，乙方应按有关规定立即上报有关部门并书面通知甲方，同时按政府有关部门要求处理，由事故责任方承担发生的费用。3.4 因乙方施工给第三方造成的人员伤亡及财产损失的，应由乙方负责赔偿。由此而给甲方造成经济损失的，乙方应予赔偿。4、现场管理：n 乙方进场前应对施工人员进行现场的安全及质量教育，服从建设单位委托的监理公司及甲方对工程质量的监督、检查。监理公司对工程款的支付有建议权和确认权。n 乙方负责施工现场的安全和防火。n 施工过程中，乙方应制定有效的成品保护措施，并以书面形式报甲方和监理公司审定，避免因施工作业

8、对其他成品、半成品造成破坏、污染。乙方对坠落、浮物等应及时清理，坚持日做日清，严禁堆积建筑垃圾。第五条 工程质量：n 工程质量应达到国家有关质量标准。n 乙方应认真按照规范和设计图纸要求以及甲方依据合同发出的指令施工，随时接受甲方的检查检验，为检查检验提供便利条件。3、质量保修：乙方应按法律、行政法规或国家关于工程质量保修的有关规定，对交付甲方使用的回填土及场地整平部位在打桩结束前有保修责任。第六条 竣工验收与结算1、乙方在工程竣工前5日应书面通知甲方及监理公司验收，如甲方不能按时参加验收，须提前通知乙方，双方另行确定验收日期，乙方工期顺延。2、竣工验收由甲乙双方联合进行，需要政府部门参与的，

9、应按照相关规定进行。验收标准按国家颁布的相关标准及规范。3、工程完工验收合格后3日内，乙方向甲方移交完毕，并应在工程移交后7日内撤离施工现场。5、竣工验收合格时间为乙方实际竣工日期。6、 决算工程量依据：实测场地30m*30m网格图、实测回填土及场地平整的长度和宽度。第七条 发包人权利与义务1、开工前，向承包人提供场地、临时水电等情况并向承包方进行现场交底，并说明使用注意事项。2、工程部现场工程师 严国祥 为发包人驻工地代表，负责合同履行。对工程质量、进度进行监督检查，办理验收、变更、登记手续和其他事宜。3、协调有关部门做好现场周边的定位放线工作及与其他相关单位的协商沟通工作。第八条 承包人权

10、利与义务1、参加发包人组织的施工图纸或作法说明的现场交底，拟定施工方案和进度计划，交发包方审定。2、负责发包人总电源至施工机械电源线、配电箱及计量表的安装。3、乙方指派 为承包人驻工地代表，负责按要求组织现场施工、人员调配、机械进场等，按发包人要求的顺序保质、保量、按期完成本工程，并达到设计规范要求。4、严格执行施工规范、安全操作规程、防火安全规定、环境保护规定。严格按照发包方的要求进行施工，做好各项质量检查记录。5、遵守国家或地方政府及有关部门对施工现场管理的规定，妥善保护好施工现场周围建筑物、设备管线、古树名木不受损坏。做好施工现场保卫和垃圾处理等工作。6、 负责所承揽工程竣工资料的编制并

11、移交给发包人。第九条 关于工期的约定1、本工程双方约定工期为 10 个有效工作日。工期从具备施工条件时计算，如在施工期间内因下雨而致使不能施工的，工期顺延2个有效工作日。2、因承包人责任，不能按期开工或中途无故停工，影响工期，工期不顺延。3、因非承包人原因造成的停工及不可抗力因素影响，工期相应顺延。第十条 付款方式本工程付款条件如下：施工结束后，经甲方合格，甲方付乙方工程款总价的50%；待别墅区域打桩结束后，甲方付乙方工程款总价的75%，待年底春节前，甲方付乙方剩余的全部工程款。第十一条 违约责任1、 因乙方原因，合同无法继续履行时，应通知对方，办理合同终止协议，并由责任方赔偿对方由此造成的经
