39、及合同名称见投标须知前附表(以下简称“前附表”)第1项和第2项所述。1.2 本招标工程根据有关规定，已办理招标申请，并得到相关主管部门的批准。现通过公开招标择优选定总承包商。1.3投标人应充分了解工程所在地的气象条件和地理位置。2. 资金来源 招标人的项目建设资金是通过前附表第3项所述方式获得，并按合同规定支付。3. 资质与合格条件要求3.1为保证履行本工程的合同，投标人应满足前附表第4项所要求的资格。3.2投标人应提供符合招标文件要求的资格文件，证明其具备规定的合格性，以及有能力和充分的条件来有效地履行合同(投标人必须如实反映实际情况，对自己所报投标资料的真实性负责，弄虚作假骗取中标的中标无

41、标文件5. 招标文件的组成5.1本招标文件包括投标人须知、合同条款，协议书格式、技术文件、投标报价要求、投标文件、资格审查文件、评标办法，以及所有按本须知第7条发出的补充资料和第14条所述的答疑材料等。5.2投标人应认真审阅招标文件中所有的投标须知、合同条款、规定格式、投标文件内容要求。如果投标人的投标文件不能符合招标文件的要求，责任由投标人负责。实质上不响应招标文件的要求的投标文件将被拒绝。6.招标文件的澄清投标人在接到招标文件后，若有问题需澄清，须在投标截止前十五天将问题以书面形式提交招标代理机构。对投标人提出的问题，招标人将整理成书面材料，在投标截止前十二天答复所有获得同一招标文件的投标
42、人。7.招标文件的修改7.1在投标日期截止前15天，招标人可能会以补充通知的方式修改招标文件。7.2补充通知将以书面形式发给所有获得同一招标文件的投标人，补充通知作为招标文件的组成部分，对投标人起约束作用。三、投标报价说明8.投标报价8.1投标文件报价中的固定单价和固定总价全部采用人民币表示，所有投标均以人民币报价。8.2除招标文件规定之外招标人不接受任何有选择的报价，只允许有一个报价。8.3投标报价的要求详见第五章。四、投标文件的编制9.投标文件的语言投标文件、投标人与招标人之间与投标有关的来往通知、函件、资料和文件均使用中文。10.投标文件计量单位投标文件中所使用的计量单位，除招标文件中有
43、特殊要求外，应采用国家法定计量单位。11.投标文件的组成投标人的投标文件应包括下列内容：u 投标书；u 法定代表人资格证明书或授权委托书；u 投标技术文件（包括总承包方案）；u 投标报价、分项报价明细表等；u 招标文件规定提交的其它资料；u 投标人应提供的其它资料。12.投标有效期12.1投标有效期：90天（日历日）。12.2在原定投标有效期满之前，如果出现特殊情况需要延期，报有关部门批准后，招标人将以书面形式通知所有获得同一招标文件的投标人，投标人应以书面形式给予答复。13.投标保证金13.1投标人应提供不少于前附表第6项规定的投标保证金，此投标保证金是投标文件的一个组成部分。13.2投标保
44、证金只接受电汇、现金、支票、银行汇票。13.3投标保证金于投标人递交投标文件的同时交纳，对于未能按要求提交投标保证金的投标人，招标人将视为不响应投标而予以拒绝。13.4投标人如发生下列情况之一者，将被没收全部投标保证金：13.4.1投标人在投标有效期内撤回其投标文件；13.4.2投标人在规定的时间内若因自身的原因未能提交履约保证金或签订合同协议；13.4.3招标文件规定的其它情况；13.5中标人的投标保证金将于合同签订且交纳履约保证金后7天内退还中标人(无利息)；13.6未中标人的投标保证金将于招标人与中标人签定合同后7天内退还 (无利息)。14.招标答疑14.1投标人在自行完成现场踏勘后，如
45、有疑问，须在投标截止前十五天将问题以书面形式提交招标代理机构。对投标人提出的问题，招标人将整理成书面材料，在投标截止前十二天答复所有获得同一招标文件的投标人。14.2招标人向投标人提供的招标文件和所附资料及提出问题的书面答复，是现有的能使投标人可利用的资料。投标人据此做出的理解、推论及结论，招标人一律不负责。15.投标文件的份数和签署15.1投标人应编制投标文件“正本”一份和按前附表第8项要求份数的“副本”，并标明“投标文件正本”和“投标文件副本”。如正本和副本有不一致之处，以正本为准（投标人投标时须以光盘形式同时提供一套投标文件电子版）。15.2投标文件正本与副本必须打印清晰，装订成册。投标
46、文件应以投标人的法定代表人签署或经合法授权的委托代理人签字；投标文件必须加盖投标人的单位公章。15.3全套投标文件应无涂改和行间插字，如必须修改，修改处应由法定代表人(或授权代理人)签字并加盖单位公章。五、投标文件的递交16.投标文件的密封与标志16.1投标人应将投标文件的正本和副本分别密封在内层封套内，再密封在一个外层封套内，并在包封上标明“投标文件正本”和“投标文件副本”。16.2内层和外层的封套上都应写明招标人名称、工程名称、招标编号、并注明开标时间以前不得开封。在内层的封套上还应写明投标人的名称与地址、邮政编码，以便投标出现逾期送达时能原封退回。内层和外层的包封都须加盖单位公章，若外层
47、封套没有加盖公章或破损严重，招标人将拒收。16.3投标文件递交至前附表第9项所述的单位和地址。16.4投标文件的包封形式为：文件按“投标文件正本”和“投标文件副本”分别密封。17.投标截止期17.1投标文件应按前附表第10项规定的日期和时间之前由专人送达招标人。17.2如发生特殊情况，需延长投标截止时间，招标人将以补充通知的方式，通知所有取得同一招标文件的投标人。在上述情况下，招标人与投标人在投标截止前的全部权力、责任和义务，将适用于延长后新的投标截止时间。18、投标文件的修改与撤回18.1投标人可以在递交投标文件以后，在规定的投标截止时间之前，可以书面形式向招标人递交修改或撤回其投标文件的通知。在投标截止日期以后，不能更改投标文件。
