1、 东方广场中心广场天幕配套水电安装 工程机电安装工程承包合同建设单位：佛山市世纪东方物业经营管理有限公司 施工单位：佛山市华宇建筑工程有限公司 合同编号：2011- 建设单位（甲方）：佛山市世纪东方物业经营管理有限公司 承包单位（乙方）：佛山市华宇建筑工程有限公司 根据中华人民共和国合同法及有关规定，结合本工程的具体情况，为了明确双方各自的权利义务和经济责任，分工合作，保质、及时地完成本工程各项任务，经甲、乙双方同意签定本合同，共同遵守。第一章工程概况及工程内容一、工程名称：东方广场中心广场天幕配套水电安装工程 二、工程地点：佛山市禅城区东方广场 三、工程范围及内容：按照甲方确认的施工图纸、甲

2、方所委托的佛山市建宇工程建设管理顾问有限公司（工程管理中心）于2011年10月12日发出的东方广场天幕给水、消防安装工程报价要求、东方广场天幕电气安装工程报价要求及于2011年10月31日发出的东方广场天幕电气安装工程报价要求（补充一）、会审记录、工地现状等内容进行东方广场中心广场天幕全部配套水电安装工程（含LED屏钢结构雨棚及基座）的施工。具体包括：广场音响系统、照明电气、监控系统、给水消防系统（含消火栓给水、自动报警系统、水喷雾系统、生活给水系统）、防雷系统、排风及电动葫芦等相关系统、LED屏钢结构雨棚及基座等。第二章工程造价及付款结算一、工程含税暂定造价：￥5700000.00元（大写：

3、伍佰柒拾万元整）（其中：安全文明施工费约为￥123913.00元）。主材要求如下：1. 消防给水管采用广州珠江牌国标内外热镀锌钢管；2. 消火栓箱采用南海平安厂大号消火栓箱，消火栓栓头采用福建天广品牌；3. 消火栓阀门采用广州越海；4. 给水管采用联塑PP-R 1.6MPa给水管；5. 大于DN50阀闸采用广州越海阀门，小于等于DN50的采用宁波埃美柯铜阀门；6. 自动报警系统采用北京利达产品（与银州城主机兼容）；7. 水泵采用佛山水泵厂水泵；8. 电缆、电线：沥光、深圳深蓝电缆、中联电缆厂、东莞民兴电缆厂等国标产品9. 断路器、漏电开关：凯隆开关厂、广东珠江、常熟开关等10. 插座、指甲开关

4、、人体感应开关、住宅配电箱：俊朗、松本等11. 塑料线槽：联塑、深塑等国标产品12. 镀锌线槽： 最大边长60mm 厚度0.5mm60 mm最大边长100mm 厚度0.8mm100mm最大边长250mm 厚度1.0mm250mm最大边长400mm 厚度1.2mm400mm最大边长600mm 厚度1.5mm13. 光管及支架：电工牌、汾江牌、佛山照明。14. 应急灯、指示牌：佛山东方星、中山振辉及同等档次有3C认证的产品。15. 低压配电柜：广特电气、顺特电气16. 低压配电柜开关：ABB、常熟开关等17. 风机：德通乙方所选用、采购的材料及设备必须符合或高于现行国家有关标准产品要求，提供合格产

5、品质量证明文件。监理单位有权按照规定对施工单位采购的材料进行抽检，乙方应积极配合并负责检验费用。二、承包方式：除灯具外包工包料。三、结算及付款办法：（一）结算办法：1. 按竣工图、设计变更通知及现场签证等资料，工程量按实计取；以清单计价形式结算，计价方式套用2010年广东省安装工程综合定额等广东省计价依据，以不含税总造价的92%再收取税金进行结算；各项费率按定额规定取定数值（如有浮动范围的取中值，且工程赶工费、文明工地及优质奖不予计取）；各项规费和税费按佛山市相关文件规定；人工及材料单价按按相应施工时期的“佛山市工程造价信息”的发布价；发布价中没有的材料单价按甲方所委托的佛山市紫晖工程造价咨询

6、有限公司审核的预算书（乙方须配合紫晖公司于2011年11月20日完成审对；如乙方不能及时送审预算，则以紫晖公司编制的为准）中单价；如发生发布价及上述预算书中都没有的材料，则其单价按双方协议的市场价；相关定额中没有子目参考的清单项目及措施项目价格按上述预算书中清单项目单价。2. 结算的办理：乙方应于工程完工验收合格后40日内备齐有关技术资料、竣工图及一份结算报告、结算资料送佛山市建诚监理有限公司于7日内确认后，再送佛山市紫晖工程造价咨询有限公司审核。紫晖造价公司应于40日内审核完毕或提出意见。乙方在工程完工后60日内尚不能提交结算资料者，则以紫晖造价公司编制的结算书为准办理结算手续，乙方应无条件

7、办理签章确认手续。（二）工程款的支付约定如下：工程合同签订后七天内，甲方先支付合同造价的30%；工程量至50%时，再支付合同造价的20%；竣工前支付至合同造价60%；余款于工程竣工后六个月内支付至97%（但必须以办理完结算手续为前提）；3%作为工程质保金于该工程竣工验收合格两年后一个月内付清。乙方每月二十日向甲方递交上月二十日至本月十九日实际完成的工程量报表，甲方（及监理单位）在收到报表后十个工作日内复核完毕，并根据核定的工程量再于十五个工作日内拨付进度款。(三) 关于因甲方原因造成的停工或进度滞后问题：如因甲方原因造成的工程停工或进度滞后，停工或进度滞后时间达120天以上时，乙方才可进行索赔

8、。且索赔费用的损失及时间只能从第121天起算起。甲方应于收到乙方索赔报告15天内核实情况、并再于15天内审核答复。乙方应在停工或进度滞后一个月后15天内书面提请监理单位核实停工或进度滞后情况，并书面知会甲方继续停工后自身可能采取的措施。否则造成停工或进度滞后情况或恢复措施无法核实的，损失由乙方自负。停工造成的工期顺延问题由甲、乙双方协商确定。按上述计得的停工及复工费用按实计取另行纳入乙方结算。(四)对应付未付工程款乙方只能从该款应付未付之日起第121天开始仅计取利息。且如按甲乙双方确认的工程修正结算金额（比如已考虑补偿金额）在甲乙双方重新约定的最后时限内付款，则乙方放弃上述利息的收取，并在延迟

9、付款期间，乙方必须积极配合甲方继续推动各项工作的开展。(五)在预算确认及甲、乙双方认可的合同工期不缩短的情况下，对任何阶段性赶工（包括达到各部位预售点时间要求、售楼样板展示时间要求，但不包括因甲方的原因造成停工超过120天的赶工）乙方不得计取赶工费及其它费用。第三章工程工期及材料供应一、工期要求：本工程施工工期为2011年10月25日至2011年12月15日，共52个日历天。如甲方提供的施工场地及有关设施达不到施工条件要求，影响乙方施工的，办理签证手续后，工期顺延，顺延工期仅限于受到影响部份。如因乙方原因造成工期拖延，则每拖延一天罚款￥15000元/天，在工程结算中相应扣除。二、材料供应：1.

10、 乙方保证所供的主材、设备的品质质量，并向甲方提供合法的品质证明文件。2. 甲方供应或由甲方办理订货、加工及引进的主材设备，在交付乙方前甲方应负责对其质量进行检验，并保证满足质量要求。乙方应与甲方于现场办理验收手续，并对交验合格的主材、设备的施工质量负责，对进场交验收的主材、设备负保管责任。3. 由甲方负责提供的主材、设备，如未按期供应或规格、质量不符合要求，因此造成乙方损失者，应由甲方承担。4. 对于甲方供应的设备，乙方收取货物结算造价的3.5% 作为配合费，负责甲供设备的卸货、二次搬运、保管及协助甲方签收货物、设备就位、安装，并协助甲方对货物的质量进行把关。乙方对甲方设备应妥善使用，不得出

11、现浪费现象，如有发现按浪费货物的造价进行赔偿。第四章施工与设计变更一、乙方必须遵照国家颁发的施工验收规范和质量检验标准以及设计的要求组织施工。二、在组织施工中，如必须变更设计，应按下列程序处理：1. 如果乙方在施工中发现设计有错误，或严重不合理的地方，乙方应书面通知甲方，甲方应在三天内作出书面答复并在七天内与原设计单位商定，提出修改或变更设计文件，经甲乙双方办理签证手续后方可按修改后的设计施工。2. 施工中如遇设计变更，乙方必须经甲方审批同意，并办理签证手续后方可施工。在施工变更尚未批准前，乙方不得强行施工。3. 在施工中如遇中途停建、缓建，甲乙双方对在建工程应商定做到合理部位并进行结算。4.

12、 乙方严格执行甲方在施工过程中发出的指令并及时按期施工，不得以任何理由拒绝施工或延期施工。甲方指令引起的工程费用增加，应按工程实际情况和本合同第七条的相关规定计算，在工程结算后列入余款中支付。乙方在确定使用特殊材料工艺至少提前15天或收到甲方变更通知后七天内对相关内容进行报价。甲方在收到乙方关于变更或特殊材料工艺等报价后七天内审核完毕或提出意见。甲乙双方对达成一致意见的审核结果进行签认和施工，并作为日后结算的依据。且乙方不得以未出据造价审核结果为由而拒绝或延期施工，如有发生，则因未及时施工造成的赶工费用或给甲方造成的损失由乙方承担外，监理单位还可对乙方罚款2000元/次。三、乙方要严格执行隐蔽

13、工程验收制度，隐蔽工程完成后必须经过验收并做好记录和签证，合格后方能进行下一道工序的施工。凡隐蔽工程在隐蔽前2天均应由乙方书面通知甲方共同验收，并办理验收手续。届时如甲方未能参加，乙方可自行检查验收并应做记录，甲方应予以确认。如甲方以后提出检查时，其检查结果不符合要求者，检查费应由乙方负责，乙方无条件返工，并赔偿由此造成的甲方损失；符合要求时其检查费及因此造成的乙方损失由甲方负责。四、乙方要遵守广东省、佛山市现行建筑安装工程安全文明施工有关规定，搞好安全文明施工管理，确保安全施工。因乙方原因达不到安全文明施工的验收要求的，甲方可按视情况按￥20005000元/次的标准扣罚工程款，直接从应付工程

14、款中扣除。五、工程签证规定：甲方要求修改或增加的工程，必须以书面通知乙方，若情况紧急，可在口头通知后三天内补办书面变更通知给乙方。乙方必须于签证工程发生后10天内向监理单位报送签证单，并估算签证工程造价，如超过时限监理单位有权不予办理该工程签证，乙方自行承担后果。监理单位在收到签证单后10天内办理审核确认手续，逾期则视为同意该签证项目。单项（一次）签证工程估价超过1000元者，必须经甲方委托的佛山市建宇工程建设管理顾问有限公司及东建集团公司分管工程副总经理确认方为有效，签证办理时间顺延5天。第五章双方责任一、甲方责任：1. 工程开工前七天，向乙方提供经图纸会审后最终确认实施的施工图纸6套，包含

15、4套做竣工图之用（其中3套交甲方存档备案， 1套交紫晖公司结算用），提供工程有关技术资料、设备、主要材料的要求。2. 负责组织施工、设计、监理等有关部门进行图纸会审。3. 提供施工用水、用电至工地范围内，提供施工场地。由乙方安装水电分表及敷设表后相关线路，水电分表及敷设表后相关线路的费用由乙方负责支付。施工中发生的水、电费用由乙方承担。4. 派驻工地代表和现场监理员，对工程进度、工程质量、材料进行监督，负责签证、协调各工种的配合。解决施工过程中出现的实际问题，收集中间、竣工验收资料。5. 在施工期间，如甲方需要设计变更，甲方必须以书面通知或提供更改图纸给乙方。6. 按合同要求依时支付工程款。二

16、、乙方责任：1. 乙方委派吕斗魁 （联系电话：18610135538）为现场负责人。乙方须服从甲方（现场代表 何兆华，联系电话：13702563240 ）、甲方所委托的佛山市建诚监理有限公司（现场代表 何运龙，联系电话：13679719433）和佛山市建宇工程建设管理顾问有限公司（现场代表 李正仪，联系电话：13928688108）在委托范围内的管理。2. 乙方自行解决施工机械、工具，自行搭设临时设施及有关施工安全设施。3. 乙方要遵守广东省、佛山市现行建筑安装工程安全文明施工有关规定，搞好安全文明施工管理，确保安全施工。乙方造成的安全事故导致的一切损失由乙方承担。4. 编制施工组织设计或施工

17、方案，应经公司技术部门审定盖章，做好各项施工准备工作。5. 及时向甲方送出开工通知书，施工进度计划表，施工平面布置图，隐蔽工程验收通知，竣工报告，提供月份施工工作计划，在建工程进度月报表，工程事故报告以及提出应由甲方供应的材料、设备计划等。6. 中间验收资料必须在完工前五天内交现场监理员，竣工资料、竣工图四份在完工后三天内移交现场监理员。7. 验收合格移交之前，工程成品与半成品均由乙方负责保管。8. 乙方负责培训甲方有关人员使用及维护设备系统义务，并将操作规程及维护规程交给甲方。9. 乙方在施工期间，如有工艺技术方面上的更改，必须报经甲方审批。10. 受甲方委托负责办理以下保险：工程开工前，为

18、本合同工程办理保险；为第三方生命财产办理保险；为运至施工场地内用于永久工程的材料和本合同发包范围内的待安装设备办理保险。上述保险期从办理保险之日起至工程竣工验收合格之日止，相关保险费用已含在本发包工程造价中。第六章工程质量、保修一、竣工工程验收以国家颁发的施工验收规范、质量检验标准及施工图纸为依据。在竣工验收时，乙方应向甲方提供：1. 隐蔽工程验收记录、中间交工验收记录和工程质保资料。2. 竣工图五份（四份供甲方及物业单位存档使用，一份供结算专用）。二、乙方在工程竣工前五天将验收日期以书面形式通知甲方，如甲方不能按时参加，须提前通知乙方，并取得乙方同意另订验收日期，但须承认竣工日期。工程未经验

19、收，甲方提前使用或擅自动用，则视为工程验收合格。由此发生的质量及其他问题由甲方承担责任。三、乙方须保证通过相关部门的验收并取得相关合格证明。竣工工程验收合格，从验收之日起十个工作日内由乙方向甲方移交完毕。如甲方不能按时接管，致使已验收工程发生损失，应由甲方承担，如乙方不能按期交付或质量问题延期交付，应按逾期竣工处理；不得因结算问题而拒绝交付。四、分项工程如需单独移交甲方，以便由另一方施工单位进行施工，在移交时甲乙双方应办理中间验收手续，作为竣工工程验收之依据。五、由工程竣工验收之日起，乙方对本合同全部工程施工的质量负责保修，保修期为二年(易损品的保质期按生产商的保质期保证。乙方有培训甲方有关人

20、员使用及维护设备系统的义务，并将操作规程及维护规程交给甲方。)六、验收合格之前，工程产品与半成品由乙方负责保管。验收合格资料齐全在五天内将工程产品交甲方接收保管。第七章其他约定一、根据佛山市建筑工程安全生产文明施工措施费管理办法的规定，本合同造价已包含安全生产文明施工措施费，其支付已含在工程进度款相应比例额度中，其使用等按办法中的相关规定执行，违反约定所造成的一切后果由违约方承担。二、在施工过程中，乙方自觉遵守施工现场的有关规章制度，服从现场管理人员指挥，及时清理现场施工垃圾保持现场整齐清洁，不得在施工大楼内安排人员住宿。三、乙方原因造成工程项目施工安全或质量事故及造成一切损失，由乙方承担全部

21、责任。乙方如对监理发出的安全文明或质量整改指令拒不执行的，则甲方可视情况对乙方给予￥20005000元/次的处罚外，对不整改的工程按实际完成状况造价的60%进行结算。四、工程进度落后责任：因乙方原因，工程实际进度与经确认的进度节点计划不符，则对比进度节点，每拖延一天监理工程师可对乙方扣罚￥5000元/天，且甲方有权延期支付当月进度款。如经监理工程师对上述拖延情况进行书面催告后三天内还未见效者，除按前句所述进行罚款及延期支付当月进度款外，甲方有权解除合同或另行组织施工单位进场施工，发生的费用按本合同的计价规定计算工程价款，由甲方直接在乙方的工程款内扣除。五、乙方不得将本工程转包施工。六、施工安全
