1、ACRP Problem No. 10-01-05 Recommended: No Develop a model Use Agreement to serve as the basis of negotiations between Air Cargo carriers and all categories of Airports ACRP Staff This specific application is not addressed in A01-02 nor was it discussed as needed research. Although ACRP research may

2、be able to generate a set of issues and elements that will have broad applicability to airports, the scope intends to go much deeper. It is doubtful that ACRP can generate a model agreement as individual airports represent unique conditions with regard to underlying economic resources, regulations,

3、and legal requirements that the divergences might be too difficult to overcome. This problem statement does offer value if a narrower scope were inserted into a business model concept for cargo airports that has been recommended as an area of research under the RRD 5. TRB Aviation Group Aviation Eco

4、nomics a number of them are quite different, sometimes diametrically opposed. There are very few examples of airports and cargo airlines negotiating specific contract terms and language that differ from the standards developed for passenger airline operations and facilities. Airport Use Agreements a

5、re the cornerstone of the airport / airline relationship. Development of a set of tools to help both parties construct an agreement that is cognizant of and responsive to those elements that are uniquely applicable to the Air Cargo segment will permit both parties to address these issues clearly and

6、 concisely in their contracts and subsequent contract administration. In the face of the uncertainty caused by the current economic crisis, the domestic modal shift to trucking, and the impact of new federal screening requirements, it is critical for airport management to utilize the most appropriat

7、e emerging ideas and innovative business and financial approaches to assure that they can sustain and improve the delivery of their services to all users of the airport. This work will assist future airport managers in those efforts. III. Objectives The objectives of this research program will be to

8、: (1) Investigate the differences between Air Cargo operators and passenger airlines with respect to their operations and facilities at all levels of airports. (2) Provide an in depth discussion of those issues and their relevance at different categories of airports; (3) Provide different strategic

9、alternatives that airports may consider when initiating discussions with air cargo operators with respect to the Use Agreement. (4) Develop a guidebook which will recommend language that can be used in Use Agreements between airports and Air Cargo operators. For purposes of this research project Air

10、 Cargo operators will be deemed to include: Integrated express airlines, heavy lift cargo airlines (scheduled and charter), ACMI cargo airlines and contractors working either in support of the carriers listed above or operating independently. IV. Research Proposed The basis of this research project

11、will be an in depth investigation into the material differences between Air Cargo operators and passenger airlines in their operations at airports throughout the country and how those differences are addressed in the existing Use Agreements. The work will include development of relevant background o

12、n the airports regional cargo operations and identify similarities and differences and how those differences are reflected in the agreements. This will facilitate the production of a matrix that will enable all airports to make easy and relevant situational comparisons. Subsequently, language will b

13、e developed that will enable airports with dramatically different levels of cargo operations to identify and address those differences applicable at their specific facilities. In order to accomplish the objectives the following tasks must be accomplished: (1) Conduct a thorough review of outstanding

14、 literature, leases and operating agreements and other relevant secondarysource documents. (2) Conduct a comprehensive set of interviews with relevant figures in the industry to identify thekey issues to be addressed; (3) Conduct a survey of an appropriate number of representative airports to determ

15、ine how their current Use Agreements address differing requirements between passenger carriers and cargo operators. (4) Develop a set of proposed language for each category of airport (large hub, medium hub, small hub, nonhub and general aviation)that addresses the areas of conflict ; (5) Prepare an

16、 interim report which will: (a) provide a comprehensive description of the current state of industry practice, (b) analyze the short comings of the current practices, (c) suggest language to address the areas identified as problematic, and (d) present a detailed work plan for the remaining tasks in

17、the project. (6) Based upon the outcome of the interim report review, develop the guide book as a stand alone document along with a plan to promote its availability to the target audience, airport management at all levels of airports. V. Estimate of Funding and Research Period (1) Estimated time for

18、 the project is eighteen (18) months including three (3) months for review and revision of a draft final report. (2) Estimated cost is $300,000 which includes ancillary costs and expenses. VI. Urgency and Payoff Potential As a result of dramatic stimuli and evolving management responses the air carg

19、o segment of commercial aviation has evolved quite rapidly into its current form. The legal and business relationships between airports and air cargo operators have in many instances failed to keep pace with these changes and as a result costly penalties are often paid by both parties for using inap

20、propriate / incompatible legal language in modified Use Agreements. The product of this research will permit the parties to negotiate new or replacement document which more accurately reflects a preferred business model. They will be able to do this with a better mutual understanding of the issues a

21、nd potential resolutions for them. In many instances, a more realistic and innovative business agreement will produce demonstrable and measurable savings for the carriers, increased revenues or business growth for the airport and a stimulus for additional cargo activity. The better the parties under

22、stand the key elements of one anothers approaches to their business, the greater efficiency and effectiveness can be brought to the conduct of that business. Completion of this research project will serve as another step along the path of developing understanding between related but distinct institu

23、tions. VII. Related Research To our knowledge there has never been a serious inquiry into this subject. We are aware that there is an ongoing project, ACRP 0107, AirportAirline Agreements and Rate Methodologies, which focused on the airport/airline relationship. However, a discussion with the Princi

24、pal Investigator for that study revealed that the thrust of their research is keyed on the traditional Agreements and Rate Making issues and does not examine the air cargo carriers as a discreet entity. It appears that this Problem Statement would be a logical and beneficial follow on to the work be
