1、本租约模本使用说明NotesofthisTemplateTenancyAgreement.本租约同时适用于乙方(承租方)为个人或公司的情形,但特别注明仅适用于乙方为个人的情形或仅适用于乙方为公司的情形的条款除外。ThistemplateisapplicabletoPartyB(Tenant)aseitherindividualtenantorcompanytenant,exceptasexpresslyprovidedforthatanyclauseshallbeappliedtoPartyBasindividualtenantonlyorcompanytenantonly.2 .请于本租约附

2、件一中填入房屋交付时该房屋的附属设施设备情况,以及水、电、煤等公用事业费计量表度数及钥匙数量。InAppendixI,pleaseinserttheinformationofthefacilitiesandequipments,themeterreadingforpublicutilityfeesandthekeynumbersuponhand-overoftheProperty.3 .本租约正文条款为通用条款,对其任何补充、修改请于附件二中列明。Themaincontextofthistemplatetenancyagreementprovidesgeneralterms,andanysup

3、plementsoramendmentstowhichshallbestipulatedinAppendixII.4 .请于本租约附件三中粘贴甲方(出租方)身份证明(如营业执照、身份证、护照等)以及该房屋的房产证的复印件。InAppendixIII,pleaseattachthecopyofidentificationdocumentofPartyA(Landlord)(e.g.BusinessLicense,IDcardorpassport)andthecopyofthepropertyownershipcertificateoftheProperty.5,请于本租约附件四中填写包括房屋地址

4、建筑面积、租金、租赁期限、续租、保证金、交付日、甲方银行账户在内的商业性条款。其中第六条“租金”中第16项同时适用于酒店式公寓和非酒店式公寓;第7一11项仅适用于酒店式公寓;第56项所列会所会籍费、停车费,如属个人所得税应纳税项目,则应填写其单独金额,如非属于应纳税项目,则不应单独列明金额。InAppendixIV,pleasefillincommercialtermsoftheleasesuchaspropertyaddress,constructionarea,rental,leaseterm,renewal,deposit,hand-overdate,PartyAsbankaccoun

6、dtospecifytheamountseparately.租约TENANCYAGREEMENT出租方(甲方):Landlord(PartyA):地址:Address:电话:PhoneNumber:承租方(乙方):Tenant(PartyB):地址:Address:电话:PhoneNo.:甲、乙双方在平等、自愿、诚实信用的基础上,经协商一致,就乙方向甲方承租房屋事宜按以下条款及条件达成本租约(“本协议”):Onthebasisofequality,voluntarinessandgoodfaith,thisTenancyAgreement(thisaAgreement)ismadeinrela

7、tiontotheleaseoftherealestatefromPartyAtoPartyBonthetermsandconditionsmutuallyagreedbyandbetweenthePartiesheretoasfollows:租赁房屋状况:StatusofthePropertytobeleased:1.1 甲方同意将其所有的房屋(“该房屋”,详见本协议附件四第1条)及其现有装修及家具、家电设施设备(“附属设施设备”,详见本协议附件一)在良好可租赁状态下租给乙方。该房屋建筑面积(洋见本协议附件三)最终应以房地产权证/房屋所有权证记载为准。PartyAherebyagreesto

8、leaseitsownproperty(the“Property”,PLEASEREFERTOCIaUSe1inAPPendiX4hereoffordetails)togetherwiththeexistingfitting-OUt,furnitureandelectricalappliances(theFacilities&Equipment,PLEASEREFERTOAPPendiX1hereoffordetails)thereiningoodandtenantableconditiontoPartyB.TheconstructionareaoftheProperty(PLEASEREFE

9、RTOAPPendiX3hereoffordetails)shallbefinallysubjecttotherecordoftherealestateownershipcertificate.1.2 该房屋仅供乙方(如乙方为个人)或乙方(如乙方为一家公司)之职员(“实际居住人详见本协议附件四第2条)作为住宅使用。ThePropertyissubjecttoresidentialuseonlyforPartyB(ifPartyBisanindividual)ortheemployee(三)ofPartyB(ifPartyBisacompany)(the“ActualResident”,PLEA

10、SEREFERTOCIaUSe2inAPPelIdiX4hereoffordetails).1.3 甲方承诺并保证其对该房屋拥有合法完整的所有权,有权向乙方出强该房屋,该房屋他项权利状况应如本协议附件四第3条规定所JOPartyAundertakesandguaranteesitsfullandlegaltitletothePropertyandtherighttoleasethePropertytoPartyB,andsubjectonlytotheencumbrancesoverthePropertySETOUTINClaxISe3inAPPendiX4hereof.二、租赁期和续租:Le

11、aseTermandRenewal:2.1 租赁期应为本协议附件四第4条规定的期限(“租赁期”)。Theleaseterm(the“LeaseTerm)isSTIPULATEDINClaUSe4inAPPendiX4hereof.2.2 租赁期届满,乙方如要求续租,须在本协议期满前贰个月向甲方提出书面申请。在同等条件下,乙方享有优先续租权,续租期为本协议附件四第5条规定的期限。双方应在本协议期满前壹(1)个月签订续租协议。除租金、租赁期及本款规定之优先续租权外,续租协议的条款条件应及本协议相同。续租租金由双方根据届时市场价格合理商定,但调整幅度不得超过本协议附件四第5条规定的范围。Uponex

12、piryoftheLeaseTerm,ifPartyBwishestorenewthelease,PartyBshallhavetheprioritytorenewtheleaseonthesameconditionforatermasSTIPULATEDINClaUSe5inAppendix4hereof,providedthatPartyBshallissueawrittennoticetoPartyAtwo(2)monthspriortotheexpiryoftheLeaseTerm.ThePartiesshallenterintoarenewedtenancyagreementone(

13、1)monthpriortotheexpirydateofthisAgreement.TermsandconditionsoftherenewedtenancyagreementshallremainunchangedasthoseunderthisAgreement,exceptforrent,leasetermandthepriorityofrenewalstipulatedhereunder.TherentfortherenewedtermshallbenegotiatedbetweenthePartiesaccordingtothethenfairmarketvalue,butthec

14、hangeintherentshallnotexceedtheextentSTlPULATEDINCIaUSe5inAPPendiX4hereof.三、租金及支付方式:RentandPaymentMethod:3.1 租赁期内,本协议下之租金(“租金”)应如本协议附件四第6条规定所示。DuringtheLeaseTerm,therenthereunder(the“Rent”)shallbeSUBJECTTOClaUSe6inAPPendiX4hereof.如租赁期首日所在的第一个日历月的租赁期间不足一个日历月,或者租赁期满或提前终止时的最后一个日历月内的租赁期间不足一个日历月,则该等月份的租金

15、应按照该月内的实际租赁天数计算。Shouldtheleaseperiodofthefirstcalendarmonth,inwhichthefirstdayoftheLeaseTermfall,beshortofacalendarmonth,ortheleaseperiodofthelastcalendarmonthpriortotheexpirationorearlyterminationoftheLeaseTermbeshortofacalendarmonth,therentforsuchmonthshallbecalculatedbasedontheactualdaysunderleas

16、ewithinthismonth.3.2 租金须按日历月以人民币支付,各月应付租金乙方应于当月的第十四(14)日或之前付清。尽管有前述规定,甲方应于每月付款到期日前的十四(14)日或之前提供税务发票予乙方,乙方应在收到甲方的税务发票后十四(14)日或上述付款到期日(以较晚的为准)内汇至如本协议附件四第9条所示的甲方银行账户,相关银行手续费由乙方承担。TherentshallbepaidinRMBonacalendar-monthlybasis,onorbeforethefourteenth(14th)dayofeachcalendarmonth.Notwithstandingtheforego

17、ing,PartyAshouldissueataxinvoicetoPartyBatleastfourteen(14)dayspriortotheduedateforthepaymentoftherentonamonthlybasis,andPartyBshouldremitthepaymenttothePartyAsbankaccountasSETC)UTINClaUSe9inAPPendiX4hereofbythelatterof(x)theexpirationoffourteen(14)daysafterreceivingthetaxinvoiceor(y)theabove-mentio

18、nedduedateforthepayment.AnyrelevantbankchargesshallbebornebyPartyB.3.3 如乙方逾期超过三十(30)日未付租金,且经甲方书面催告后仍未支付,则甲方有权终止本协议,乙方已支付之保证金(见下文定义)将用于所欠租金的抵偿,余额(如有)应在本协议终止后七日内无息退还乙方。IftherenthasnotbeenpaidbyPartyBformorethanthirty(30)daysaftertheduedateandisstilloutstandingafterPartyAgivingdemandnoticeinwriting,Par

19、tyAisentitledtoterminatethisAgreement.TheDepositasdefinedbelowwillbeusedtooffsettheoutstandingrent.Andthebalance(ifany)shallberefundedtoPartyBwithinseven(7)daysupontheterminationofthisAgreementwithoutinterest.3.4 在租赁期内,租金不予增加。TherentshallnotbeincreasedduringtheLeaseTerm.四、其它费用:OtherExpenses:4.1 租赁期内

20、乙方所用电话费按电信局标准收费,每月结算实际用量(基本月租费由甲方承担)由乙方按单据自行缴付。TelephoneexpensesshallbepaidbyPartyBaccordingtoactualusageduringtheLeaseTermandbasedontheTelecommunicationBureaustandardtariffsandthebillsreceived(PartyAshallberesponsibleforthebasicmonthlytelephonefee.).4.2 租赁期内发生的公用事业费(包括水、电、煤气、取暖费)由乙方承担,但本协议另有规定的除外。P

21、ublicutilityfees(includingwater,electricity,gasandheatingcharges)incurredduringtheLeaseTermshallbebornebyPartyB,unlessotherwiseagreedhereunder.五、保证金:Deposit:5.1 本协议签订后十(10)日内,乙方应按本协议附件四第7条规定的数额向甲方缴付租赁保证金(“保证金”),甲方应在本协议签订后向乙方提供付款通知,并应在收到保证金后五日内向乙方提供收据。租赁期满,乙方如不再续租,或本协议提前终止,甲方应在租赁期满或提前终止,且乙方将应缴付的电话费及公

22、用事业费付清或可自保证金中扣除该等电话费及依据公用事业费计量表度数计算的公用事业费后的七日内将保证金无息退还。Withinten(10)daysuponexecutionofthisAgreement,PartyBshallpaytoPartyAthedepositACCORDINGTOClaUSe7inAPPendiX4hereof(the“Deposit).PartyAshallissueadebitnotetoPartyBaftersigningoftheAgreementandalsoissueareceipttoPartyBwithinfive(5)daysuponthereceip

23、toftheDepositfromPartyB.UponexpirationoftheLeaseTerm,ifPartyBdoesnotrenewthelease,orupontheearlyterminationofthisAgreement,PartyAshallrefundtheDeposit(withoutinterest)toPartyBwithinseven(7)daysafterPartyBhaspaidallapplicabletelephoneexpensesandthosepublicutilitychargesorafterdeductingtherefromsuchte

24、lephoneexpensesandpublicutilitychargesascalculatedaccordingtothemeterreadingforpublicutilityfees.5.2 乙方如违反本协议规定,致使甲方未能如期收取租金或因而发生费用开支,甲方可以根据实际损失以保证金抵付,不足部分甲方有权请求乙方赔偿,乙方必须在接到甲方付款通知后十(IO)日内补足保证金。IfPartyBbreachesthisAgreement,sothatPartyAdoesnotreceivetherentbeforetheduedate,orsuffersadditionalexpenses

25、PartyAisentitledtoretainpartorthewholeDeposittocompensateitsactuallosses.IftheDepositisinsufficienttocoverPartyAsloss,PartyAmayclaimagainstPartyBforcompensation,andPartyBshallmakeuptheDepositwithPartyAwithinten(10)daysuponreceivingthedemandnoticefromPartyA.六、甲方的责任:PartyAsResponsibilities:6.1 甲方须于本协

26、议附件四第8条规定的交付日(“交付日”)前将该房屋及附属设施设备以良好、完整、清洁的状态交付乙方使用。甲方应尽量提供附属设施设备的说明书,或就附属设施设备的使用做出说明和指导。双方应按本协议附件一所示状况对该房屋及附属设施设备进行验收、记录公用事业费计量表度数并交付钥匙。自该房屋交接书签署并且钥匙交付之时起该房屋视为交付给乙方。PartyAshallhandoverthePropertyandtheFacilities&Equipmentinagood,completeandcleanconditiontoPartyBforusebeforethehand-overdateASSTlPULAT

27、EDINCIaUSe8inAPPendiX4hereof(theaHand-overDate).PartyAshallendeavortoprovidethemanualoftheFacilities&Equipment,orprovideexplanationandinstructiononhowtousethesame.ThePartiesshallinspectandacceptthePropertyaswellastheFacilities&EquipmentonsuchconditionsasindicatedinAppendix1,recordthemeterreadingforp

28、ublicutilityfeesanddeliverthekey.ThePropertyshallbedeemedashavingbeenhandedovertoPartyBupontheexecutionoftheletterofhand-overofthePropertyanddeliveryofthekeys.6.2 如届时因甲方原因不能按时交付该房屋的,则双方同意本协议项下的交付日和租赁期相应顺延,且自逾期交付之日起,甲方应向乙方按日支付月租金的0M作为违约金。但如逾期交付超过十(Io)日,则乙方有权解除本协议,并要求甲方赔偿乙方因此而遭受的任何损失。IfthePartiesfails

29、tohandoverthePropertyduetoPartyAsreason,thePartiesagreethattheHand-overDateandLeaseTermshallbepostponedandextendedaccordingly,andPartyAshallpaytoPartyBanamountof0.1%oftherentforeachdayindefaultaspenalty.Ifthehand-overisdelayedforoverten(10)days,PartyBisentitledtoterminatethisAgreementandclaimagainst

30、PartyAforanylossesincurredtherefrom.6.3 甲方须自付费用负责对该房屋及其附属设施设备进行三个月一次的定期维修维护,特别应在季节更替前对空调、取暖设施进行定期维修维护。除定期维修维护外,如出现不明原因的烟火、漏水溢水、漏电或漏气,或该房屋或其附属设施设备因其自身质量原因受到损坏时,甲方应在接到乙方通知之时起三日内及时完成修缮工作并承担有关的费用。紧急情况下,如该损坏将对乙方人身或财产安全造成即时损害的,则甲方应在接到乙方通知之日起24小时内自费完成维修工作。若甲方未能在上述期限内修复的,乙方有权自行修理或更换,并且所产生费用由甲方偿付,乙方亦有权在下一期租金

31、中扣除该等费用。如该房屋的任何损坏严重影响居住的(如空调、取暖设施持续失灵,或不明原因的烟火、漏水溢水、漏电或漏气持续出现,或乙方的财物因而发生重大损失),则乙方有权在书面通知甲方后单方面终止本协议,并不视为违约,甲方应在本协议终止后七(7)日内赔偿乙方因此而遭受的实际损失。但如乙方决定继续履行本协议,则甲方仍应继续履行该维修义务,并在维修期间,向乙方免费提供不低于该房屋条件的住所。PartyAshallberesponsibleforregularmaintenanceandrepairofthePropertyandtheFacilities&Equipmentonceeverythree

32、months,especiallyforregularmaintenanceandrepairoftheair-conditionersandheatingfacilitiespriortotheshiftoftheseasons.Inadditiontotheregularmaintenanceandrepair,ifthereoccursafireorsmoke,leakageoroverflowofwater,leakageofelectricityorleakageofgas,forunknownreason,orthePropertyortheFacilities&Equipment

33、aredamagedduetotheirpoorquality,PartyAshallatitsowncostcompletetherepairworkwithinthree(3)daysuponreceivingthenoticefromPartyB.IncaseofemergencywheresuchdamagemayleadtoimmediatepersonalinjuriesordamagetoPartyB,PartyAshallcompletetherepairworkatitsowncostwithintwenty-four(24)hoursuponreceivingPartyBs

34、notice.IfPartyAfailstorepairwithintheabove-mentionedperiod,PartyBmayrepairoreffectthereplacementitself,andthereaftertobereimbursedbyPartyA,ordeductsuchexpensessoincurredfromthenextduerent.IfanydamagetothePropertyseverelyaffectsPartyBsrighttousethePropertyasaresidence(e.g.,continuousno11-operationofa

35、ir-conditionersorheatingfacilities,orcontinuousfireorsmoke,leakageoroverflowofwater,leakageofelectricityorleakageofgas,forunknownreason,ormaterialdamagestotheassetsofPartyBtherefore,etc.),PartyBmayunilaterallyterminatethisAgreementuponservingPartyAawrittennotice,whichshallnotbedeemedasbreachingofthi

36、sAgreement,andinwhichcasePartyAshallcompensatePartyBforPartyBsactuallosswithinseven(7)daysuponterminationofthisAgreement.However,ifPartyBdeterminestocontinuetheperformanceofthisAgreement,PartyAshallcontinuetoperformitsobligationforrepairandmaintenance,andprovidePartyBwithaccommodationsonconditionnow

37、orsethanthatofthePropertyforfreeduringtheperiodforrepairandmaintenance.6.4 如在租赁期内,该房屋发生所有权全部或部分的移转或其他影响乙方权益的事情时,甲方应保证所有权人或其他影响乙方权益的第三者,能继续遵守本协议所有条款,反之如乙方权益因此而遭受损害,甲方应负赔偿责任。DuringtheLeaseTerm,ifalloranyofthetitletothePropertyisassignedoranyotherhappeningaffectstherightsandinterestsofPartyBinrelationt

38、otheProperty,PartyAshouldguaranteethattheowneroranyotherthirdpartythataffectstherightsandinterestofPartyBcontinuetoperformthisAgreementontermshereof.Otherwise,PartyAshallbeliableforcompensatingPartyBforthelossoftherightsandinterestssosuffered.6.5 在乙方按期支付租金的情况下,甲方有义务按时向物业管理处缴纳物业服务费及向有关收费单位缴纳有线电视使用费、卫

39、星电视使用费(如适用)等根据约定应由甲方负责缴纳的费用。甲方应提前为乙方办理一切手续以保证乙方于交付日入住并正常享有物业服务,并确保乙方持续享有该等服务。PartyAisobligedtopaythepropertymanagementfeetothepropertymanagementofficeandanyotherfeespayablebyPartyAsuchascableTVusagefee,satelliteTVusagefee(ifapplicable)totherelevantentitesregularlyontimeprovidedthatPartyBpaystherentt

40、imely.PartyAshallgothroughalltheformalitiesforPartyBinadvanceinordertoletPartyBtoenjoyfullbenefitofthemanagementassistanceandmoveinontheHand-overDate,andprocurePartyBtoenjoysuchbenefitscontinuously.6.6 甲方应按时交纳有关政府机构要求其支付的针对该房屋的税费,包括甲方就在本协议项下租金收入应付的有关税款。PartyAshallpaytheapplicabletaxesandexpensespaya

41、bleontheleasedPropertyasdesignatedbyanyrelevantgovernmentauthority,includingtherelevanttaxespayableonrentreceivedbyPartyAunderthisAgreement.6.7 甲方应当确保乙方在租赁期内拥有并享用该房屋,令其不受甲方打扰,并不受任何宣称因其隶属于甲方,或经由甲方委托为其管理而拥有该房屋管理权,或其他第三方的打扰。PartyAshallguaranteePartyBtohavequietpossessionandenjoymentofthePropertyduringt

42、heLeaseTermwithoutanyinterruptionbyPartyAoranyonewhoclaimstobeasubordinateofPartyA,orhavingtherighttomanagethePropertyduetotheauthorizationbyPartyA,oranythirdparty.6.8 租赁期内甲方不得无故收回该房屋(除非本协议另有规定)。PartyAmaynotwithoutcausetakepossessionofthePropertyfromPartyBduringtheLeaseTermunlessotherwiseprovidedher

43、eunder.6.9 租赁期内,甲方应确保物业服务企业提供充分的保安消防工作及安静清洁的居住环境。DuringtheLeaseTerm,PartyAshallensurethatthepropertymanagementservicecompanyprovidesadequatesecurity,firepreventionserviceandquiet&cleanlivingenvironment.6.10 在根据本协议有权进入该房屋时,甲方应提前通知并尽量降低对乙方使用该房屋的影响,并不得损坏乙方在该房屋内的财物。WhenenteringintothePropertyinaccordanc

44、ewiththisAgreement,PartyAshallgiveapriornoticeanduseitsbestendeavorstominimizetheinfluencetoPartyBsuseoftheProperty,andnottodamagePartyBsassetsintheProperty.6.11 甲方应负责为该房屋及其附属设施设备购买保险,以甲、乙双方为共同受益人,并在乙方要求时提供该保单及相关文件的复印件。PartyAshallberesponsiblefortakingoutinsuranceforthePropertytogetherwiththeFacilit

45、ies&Equipment.PartyAandPartyBshallbetheco-insured.PartyAshallprovidecopiesoftheinsurancepolicyandtherelevantdocumentswhenrequestedbyPartyB.6.12 甲方应确保该房屋、附属设施设备以及该房屋内的空气质量等对乙方/实际居住人的安全性,并不对其正常居住产生任何不利影响。PartyAshallguaranteethesafetyoftheProperty,theFacilities&EquipmentandtheairqualityinthePropertytoP

46、artyB/theActualResident,andensurenoadverseeffectontheActualResident?snormalresidence.七、乙方的责任:PartyB,sResponsibilities:7.1 乙方应按本规定交付租金,保证金和各项费用,如有拖欠,则作违约论。PartyBshouldpaytherent,depositandotherexpensesinaccordancewiththisAgreement.DefaultinpaymentwillconstituteabreachofthisAgreement.7.2 租赁期内未经甲方同意,乙方

47、不得转让和转租该房屋,乙方(如乙方为一家公司)供实际居住人或另行指定的其他实际居住人使用或乙方(如乙方为个人)转让或转租给其供职的雇主公司或该雇主公司指定的员工除外。DuringtheLeaseTerm,withoutPartyA,sconsent,PartyBcannotassignorsub-leasetheProperty,exceptthatPartyBmay,ifPartyBisacompany,providethePropertytotheActualResidentoranyotherActualResidentdesignatedbyPartyBor,ifPartyBisani

48、ndividual,assignorsub-leasethePropertytoitscorporateemployerorotherpersonneldesignatedbyhiscorporateemployer.7.3 未经甲方同意,乙方不得擅自改变该房屋的用途。PartyBshallnotchangetheusageofthePropertyinitsowndiscretionwithoutPartyAsconsent.7.4 除该房屋内附属设施设备之外,乙方如要增加设备或其他装修须征得甲方同意。但甲方无正当理由不得拒绝或拖延作出上述同意。InadditiontotheFaciliti

49、es&EquipmentintheProperty,ifPartyBwishestomakeanyalterationsordecoratetheProperty,PartyAsconsentshallbeobtained.However,PartyAshallnotrefuseordelayingivingtheabove-mentionedwrittenconsentunreasonably.7.5 乙方应赔偿由于乙方疏忽或不作为造成该房屋的损害或损失,并允许甲方或其代理人进入该房屋,对该房屋及附属设施设备的损失或损害进行弥补及修复,由此发生的费用由乙方负担。PartyBshallindemnifyPart
