4、 chapter supplementary provisionsChapter 1 General ProvisionsArticle 1 These measures are formulated for the purpose of strengthening the management of commercial measuring instruments in this Municipality, ensuring accurate measurement, fair trade, and safeguarding the interests of the state and th
5、e people.Second units and individuals who manufacture, repair, sell, import, use and verify commercial measuring instruments in this Municipality shall comply with the provisions of these measures and accept the supervision and administration by the government metrological management department.The
6、third unit of measurement adopts the system of international units. The business unit temporarily retained.The management department of fourth commercial measuring instruments is the Beijing standard metering Bureau and district (county) metering management office.The verification of fifth measuring
7、 instruments must be carried out in accordance with the national verification regulations and the provisional verification methods issued by Beijing Municipal Bureau of standard metrology.If the test is qualified, the certificate is stamped by the verification unit or issued to the certificate. Qual
8、ified printing and qualification certificate is uniformly printed by Beijing Bureau of standards and measurement.The second chapter is the establishment and verification of measuring standardThe sixth measuring standard is the basis of the unified value.The establishment of metrological standard mus
9、t be examined and approved by the metrological management department of city, district and county.The seventh standard measuring instruments must be sent to the municipal, district (county) metrological management department for verification according to the prescribed period.The third chapter is th
10、e management of manufacturing, repairing, selling and importing commercial measuring instrumentsEighth franchised or engage in manufacturing or repairing measuring instruments of commercial enterprises and individual business households, shall be subject to the metering management of its product ins
11、pection examination qualified, party may apply to the administrative department for Industry and Commerce for opening or change the scope of business registration.Ninth new instruments for manufacturing commercial measuring instruments must be applied to the metrological management department for qu
12、alification evaluation. After qualification, the party will formally put into production. The original technical index shall not be lowered after commissioning.Special commercial measuring instruments shall be made for special needs and must be submitted to the metrological management department for
13、 approval, and the finished products are qualified after verification.Tenth manufacturers of commercial measuring instruments and spare parts, by the manufacturing unit to verify their own, and reported to the measurement management department spot check or all verification, qualified after the fact

17、ent system, and shall be checked and approved by the import unit by the metrological management department, and shall be sold and used after approval.The fourth chapter uses the management of commercial measuring instrumentsDuring the use of fifteenth commercial measuring instruments, periodic inspe
18、ction must be carried out according to the regulations.Verification is carried out by the metrological management department or its authorized commercial department measuring instrument overhaul point. The verification period shall be determined by the verification unit according to the use, and the

20、t,The metrological management department of the district (county) shall carry out spot checks and verification within the prescribed period, and the number of spot checks shall not be less than thirty percent of the total number of the verification instruments.Seventeenth commercial measuring instru
21、ments purchased, repaired, re installed or debugged must be checked and approved by the metrological management department or the authorized commercial department measuring instruments and maintenance points.Eighteenth units that use commercial measuring instruments should establish management respo
22、nsibility system, maintain and use measuring instruments correctly, and keep their accuracy.The management and supervision of the use of measuring instruments on the nineteenth urban and rural markets and individual business households shall be carried out by the administrative departments of measur
23、ement and management of the district (county).Twentieth urban and rural fair market trading instruments used by the district (county) metering management department checks once a week, once every two months, universal verification.The measuring instruments used by individual business households shal
24、l be checked and checked periodically by the metrological management department of the district (county).The fair scale and fair scale of twenty-first retail units and urban and rural fair market are set up by the district (county) metering management department for periodic verification.Twenty-seco

28、onTwenty-fifth Beijing standard metering Bureau and district (county) metering management of commercial measuring instruments management functions:To publicize and implement the relevant laws and policies concerning measurement, and to organize and implement these measures;(two) conduct business gui
29、dance on the management of commercial measuring instruments in various units, and conduct technical training and assessment for measurement management personnel;(three) periodic verification and spot check on commercial measuring instruments;(four) technical examination and assessment of the inspect
30、ion and repair points of measuring instruments in the new commercial sector;(five) quality supervision of commercial measuring instruments manufactured, repaired, sold and imported;(six) technical appraisal of commercial measuring instruments;(seven) responsibility for acts violating these measures;
31、(eight) other management supervision matters.When the staff of the metrological management department of the city, district and county perform their duties, they should show the certificate of supervision and inspection of the measurement management personnel issued by the Municipal Bureau of standa
32、rds and measurement.Twenty-sixth City, district (county) commercial departments should be based on the need to set up a full-time or part-time measurement management and measuring instruments maintenance, metering management departments at the same level under the guidance of the management and main
33、tenance of the system responsible for the commercial measurement instruments. Primary and secondary stores and shopping malls may have full-time or part-time metering managers.The responsibilities of measurement managers and maintenance sites in the commercial sector:(1) publicizing and implementing
34、 the relevant laws, policies and regulations concerning measurement in china;(two) according to the specified period, the measuring standard will be sent to the metrological management department for verification;(three) periodic verification and spot check on commercial measuring instruments;(four)
35、 the education of the maintenance and correct use of measuring instruments for commercial workers;(five) check the management of the system, the enterprise commercial measuring instruments, reflect the situation, and make recommendations.The sixth chapter chargesTwenty-seventh metering management de
36、partments or measuring instruments overhaul point verification commercial measuring instruments, according to the relevant provisions of the inspection unit to receive verification fees.In the verification period, the inspection department shall be checked by the metrological management department,
37、and the verification fee shall be exempted.Twenty-eighth rural fairs and self-employed households use wooden scales, the first test retest fee, within a year, no longer qualified charges, unqualified charge double.The twenty-ninth metrological management departments should check the measurement stan
38、dard in ten days; the periodic verification of commercial measuring instruments should be completed within the prescribed time limit. Overdue inspection and completion, no verification fee.The seventh chapter penaltyThirtieth one of the following acts, municipal, district (county) management departm
39、ent is responsible for the direct responsibility of the unit, people give criticism and education; refuse to correct, ordered to disable or confiscate substandard, disable the measuring instrument; incorrigible, the directly responsible person or unit responsible person fined five yuan more than fif
40、ty yuan fine; if the circumstances are serious, and impose a one hundred yuan fine of not less than five hundred yuan of business units or individual business households.(1) the measuring standard is still used for more than the period without inspection or by unqualified verification;(two) commerci
41、al measurement instruments and by disqualification, refused to repair;(three) refusing to carry out periodic verification or spot check on commercial measuring instruments;(four) unauthorized use of commercial measuring instruments ordered by the metrological management department;(five) the use of
42、exchange platform and scale increase or increase, reduce thallium disc zero;(six) non quantitative change using wood steelyard of thallium;(seven) the use of prohibited commercial measuring instruments or other objects instead of measuring instruments.Thirty-first one of the following acts, municipa
43、l, district (county) measurement and management departments directly responsible person, the person in charge of the unit fined ten yuan to one hundred yuan fine; if the circumstances are serious, and impose a one hundred yuan fine of not less than one thousand yuan of business units and individual
44、business households; if the circumstances are especially serious, impose one thousand yuan to three thousand yuan fine; can also confiscate the measuring instruments, spare parts are not qualified, until transferred to the administrative department for Industry and Commerce shall confiscate the ille
45、gal income, or ordered to suspend or revoke the business license.(1) in violation of the provisions of article eighth and article twelfth of these measures, without permission of the metrological management department, the manufacturer shall be engaged in the manufacture or repair of commercial meas
46、uring instruments;(two) sales of substandard commercial measuring instruments and spare parts;(three) altering, embezzling or forging the qualified stamp and certificate of metrological verification;(four) seriously damaging the performance of measuring instruments.Thirty-second or more than one tho
47、usand yuan shall be reported to the peoples Government of the district (county) for approval.The fine is turned over to the financial department at the same level. The confiscated measuring instruments and fittings shall be destroyed or dealt with by the metrological management department.The fines
48、imposed on individuals shall be borne by themselves, and the fines imposed on the units shall be paid in their own funds, and shall not be included in the cost and expenses.Thirty-third, with violence, threat methods to hinder the measurement management personnel to perform their duties according to law, violation of Peoples Republic of China public security management punishment regulations, handled by the public security department.
