3、 house with Party B as its authorized agent through friendly consultation to conclude following contact. Statement from Party B: Party B, by the discretionary authorization of the landlord of the house and in accordance with the signed , is authorized to exercise the right of rental agency. Party B

4、addresses the commitment and assurance that, the signed rental contract with Party B possesses legal subject qualification. DefinitionHouse: The house leased by Party B to Party A is referred as “The House” in the contact. Party A should guarantee that the house is restricted to the residence of les

5、see, its immediate family or other individuals acknowledged by Party B. One- bedroom house is limited to three persons or below; as to the house with more than one bed room up to two persons per room The house is located at , Beijing (City) with one bedroom and one living room. All the furniture, fi

6、xtures and fittings in the house have been defined and mentioned in as an attachment to the contract. shall be applied as both the evidence of Party B leasing the house to Party A in accordance to the contract definitions and foundation of acceptance upon expiry of the lease contract.Terms: The leas

7、e term will start from 2008 year 1 month 14 date to 2009 year 1 month 13 date, totaling 12 month. If Party A would like to continue the term of leasing, prior one month is required to notify Party B to sign the lease extension agreement and 10 days in advance is requested to complete the payment of

8、rental for the extended contract. Rental: Party A shall pay the rental as 3100 RMB / Month.Down Payment: The rental of payment will be settled at a two months basis. Upon signing the lease contract, Party A needs to pay the guarantee deposit of 6200 RMB together with initial two months rental of 620

9、0 RMB totaling 12400 RMB as the down payment.Successive Payment Terms: 2008 year 3 month 14 date paying 6200 RMB 2008 year 6 month 14 date paying 6200 RMB The payment of successive installment shall be conducted in the same interval with no necessity to illustrate in details. Payment Method: Party A

10、 chooses the option 2 as the method of payment. Option 1.Following the successive installment clauses and authorizing Industrial and Commercial Bank of China with withholding capability, Party A needs to provide the debit card as per the below guidance:l Party A provides the copy version of the avai

11、lable Peony Debit Cards issued by the Industrial and Commercial Bank of China ,Beijing Branch ; the copy of citizen identity card and signed with Party B.l If Party A (who pays successive installment more than twice with the amount exceeding two -month rental per payment) authorizes Party B to issue

12、 Peony Debit Card in Industrial and Commercial Bank of China ,Beijing Branch, Party A needs to provide citizen identity card copy and sign with Party B. Upon the completion of processing Peony Debit Card, Party B will send the card to Party A in the way of Registered Letter. Party B shall not take r

13、esponsibility for the failed processing of rental withholding service caused by the inaccurate address.l Party A should deposit the sufficient rental in the designated account according to successive installment terms. l The Commercial and Industrial Bank of China will start to conduct withholding p

14、rocessing within the week of defined successive installment date or the week followed. l The registered name of Debit Card should be in accordance with the name in l If there is not sufficient amount of money within the designated Debit Card, the Commercial and Industrial Bank of China shall suspend

15、 the withholding process. If Party A fails to deposit sufficient amount of money for rental, Party B shall have the right to charge the overdue fine and take back the premises after 15 days of the overdue. Option 2.Pay cash in the designated Wo Ai Wo Jia Real Estate business outlets. Party A should

16、keep the proofs of rental payment and other expenses Important Notice:Regardless of the method applied to pay, Party A should retain the payment proofs.Guarantying the legitimate rights and interests of both sides, any supplementary content to the contract should be issued in written notice with the

17、 stamp from Party B to take affect. The oral agreement or the agreement without stamp between Party A and Party B shall not be accepted and approved.Commission: Party A should pay 1500 RMB to Party B as the intermediary services fee. Maintenance Fee: Party A shall pay / RMB to pay the maintenance fe

18、e during the term of rental. Other expenses: 1. Party A shall pay the Cable TV service fee totaling 216 RMB. Upon the term of rental extension, the extension fee for Cable TV should be paid together with rental. 2. If Party A authorizes Party B to issue the receipts, Party A should pay comprehensive

19、 real estate tax. The tax is / RMB. (Current comprehensive real estate tax equal to 5 % of the total rental.) Responsibilities of Obligation of Party A 1. Party A should present temporary citizen card, temporary residence card and employment proof etc. If Party A is not native Beijing citizen, Party

20、 A should register in a local police station within three days commencing effectiveness date of the house lease contract. Party A should guarantee the provided documents are faithful to the truth. Party B is allowed to examine and retain the copies of all the documents provided by Party A. If the do

21、cuments provided by Party A disobedient to the truth, Party B has the right to take back the premises and terminate the house lease contract. Party A shall take responsibilities to the financial lost caused by the house lease termination. The copies of documents provided by Party A are applied solel

22、y for this lease agreement.2. Prior to acknowledging the content of this house lease contract, Party A should check and identify the status of furniture, fixtures and fittings within the house and agree to use the premises for residential purpose. 3. Party A should guarantee that the house is used f

23、or Party As residence. Without the written approval from Party B, Party B shall not transfer or sublet the lease of premises. 4. Within the term of this agreement, Party A should obey statutory laws, decrees and pertinent rules and regulations.5. During the term of this agreement, Party A shall take

24、 good care of and be responsible for maintaining the house in good conditions.6. Party A should pay the sufficient rental to Party B strictly in line with the agreed payment clauses. Under no circumstances that should Party A apply the deposit to offset the rental. 7. During the term of this agreeme

25、nt, Party A shall bear all expenses of utilities including tap water / electricity / gas fee, telephone fee ,internet fee , Cable TV fee , environment maintenance fee, security fee , public use electricity fee and pay all the due rental and expenses upon the termination of the house lease . Party A

26、should retain all the payment proofs and present the proofs to Party B to settle accounts. Party B will be responsible for heat fee. 8. Within the term of this agreement, Party B shall be entitled to claim compensation from the deposit for any loss caused by Party As faults or behaviors of selling ,

27、damaging and losing the in-house equipments without authorization from Party B. If the deposit is not sufficient for the loss, Party B shall reserve the right to pursue. Meanwhile, Party A should fill the deposit within five days upon receiving the notice from Party B.9. Any damage or loss within th

28、e house is incurred due to the impropriate use of the house or as a result of man- made reasons, Party A will bear the cost of repairing and inconvenience caused by the repairing requirement.10. The damage parts incurred due to the improper use of the house shall be renewed or repaired by Party A. I

29、f any assistance to maintenance issues required from Party B, Party B shall take action within 5 days upon receiving the repairing request from Party A. Party A should pay the related expenses to Party B. Any natural damage found in the house will be subjected to Party Bs obligation, Party A shall t

30、hen notify Party B of such damage and actively coordinate with Party B in examining and repairing the damaged parts. If maintenance affects the normal use of the house due to uncooperative manners from Party A on the matters, Party B will not be responsible for the inconvenience. In case any loss of

31、 assets occurred on the third party, Party A shall be liable for compensations. 11. During the term of this agreement, Party A shall not erect, install or remove any fixtures or make any structural additions or alternation without the prior written consent from Party B.12. Upon the termination of th

32、e contract, Party A should handover the house to Party B in accordance with In-house Handover List) and clears the premises in time. Any remained belongings will be deemed to be abandoned by Party A. Party B will have the right to deal with. 13. When one month prior the contract expires, Party A sho

33、uld notify Party if it intends to extend the house lease contract and discusses the extension matters with Party B.14. If Party A intends to extend the house lease contract, Party A should sign the renewed lease contract with Party B in 10 days prior to the original contract expiry date. Otherwise,

34、Party A will be regarded as intending to terminate the contract. 15. Upon the completion of the house lease , Party A should clear the premises and keep the house tidy and in good conditions. 16. Party A will need to notify Party B about adding additional facilities to the house and get the written

35、approval from Party B to proceed. Party A is liable for the cost. When adding additional in-house equipment, Party A should not change or damage the structure of the house and original facilities. 17. Without the written consent from Party B, Party A should not raise any pets or animals. Responsibil

36、ities and Obligations of Party B18. Party B should guarantee that Party B is authorized by landlord of the house to exercise the right of rent agents. During the term of this agreement, if Party A would like to refer the personal documents of landlord, Party A should notify Party B in advance and ch

37、eck the documents with the permission from landlord. 19. Within the term of this agreement, Party B should guarantee the house could be used safely and properly. 20. During the term of this agreement, Party B is liable for repairing the damage of in-house equipment caused by natural reasons or aging

38、 of equipments.21. Upon the termination of contract, after Party A clears the premises and settle the bills with relevant payment proofs provided, Party B should be liable for returning the deposit to Party A. Given that the internet fee is scheduled to pay in the following month, Party B should not

39、 delay returning the deposit longer than 32 days commencing the expiry date of the contract. 22. After Party B takes back the house in accordance with the defined clauses, any remained belongings of Party A shall be deemed to be abandoned and Party B will be entitled to deal with accordingly. House

40、Handover 23. Party B should organize and carry out house inspection according to . Inspection and examination to in - house equipment should be participated by both parties. Party A should question the status of the equipment on the spot. For any problems difficult to judge on the spot, Party A shou

41、ld notify the problems of the facilities within 3 days afterward. 24. Upon the termination of this house lease contract, Party A should conduct handover with Party B in accordance to .Liability for Breach of Contract25. If Party A fails to pay the rental before the agreed time or clear the premises

42、and return the house to Party B on expiry date, Party A shall pay penalty to Party B by 1% of the rental of current month for each day in excess of the paying time as agreed and also the rental for that month. If such overdue rental remains 15 days unpaid, Party B shall have the right to take back t

43、he house and terminate the contract. Any related loss of Party B will be subjected to Party A. 26. Party B shall be allowed to take back the house and terminate the contract and Party A will have to pay penalty to Party B equivalent to two months rental if below listed actions seriously disobedient

44、to the agreement happen: a) Without the recognition from Party B, Party A terminates the contract. b) Without written approval from Party B, Party A changes the purpose of using the house. c) Party A sublets or transfers the lease of contract. (Includes the situation of paying rental in the name of

45、Party A, but in reality to have somebody else live in the house)d) Without the permission from Party B, Party A converts the house into a public dormitory or have more than defined people reside in the house. (One bedroom house: 1- 3 pax; two bed room house: 1-5 pax; three bedroom house:1-8 pax)e) P

46、arty A uses the house for the purpose of carrying out activities with threat to the safety of the public or distracting the neighborhood community.f) Party A damages the internal structure of the house or its attached equipment and doesnt repair the damaged parts as per the agreed date. g) Delay paying the rental for 15 daysh) Delay paying other defined expenses of the house, which causes the loss of Party B or Landlord.i) Submit the false personal documents to Party B j) Store any hazardous materials, toxic goods or
