2、法律，法规，不干预中国的内部事务。 2遵守聘方的工作制度和有关外国专家的管理规定，接受聘方 的工作安排，业务指导，检查和评估，未经聘方同意，不得兼 任与聘方无关的其他劳务。 3按期完成工作任务，保证工作质量。 4尊重中国的宗教政策。不从事与教师身份不符的活动。 5尊重中国人民的道德规范和风俗习惯。 六，合同的变更，解除和终止： 1双方应信守合同，未经双方一致同意，任何一方不得擅自更 改、解除和终止合同。 2经当事人双方协商同意后，可以变更，解除和终止合同。在 未达成一致意见前，仍应当严格履行合同。 3，聘方在下述条件下，有权以书面形式通知受聘方解除合同： (1)受聘方不履行合同或者履行合同义务
3、不符合约定条件，经聘 方指出后，仍不改正的； (2)根据医生诊断，受聘方在病假连续 30 天后不能恢复正常工 作的; 4受聘方在下述情况下，有权以书面形式通知聘方解除合同; (1)聘方未按合同约定提供受聘方必要的工作和生活条件; (2)聘方未按时支付受聘方报酬。 七、违约金： 第 3 页 当事人一方不履行合同或者合同义务不符合约定条件，即违反 合同时，应当向另一方支付 5002000 美元(或相当数额人民币)的 违约金。 受聘方因不可抗力事件要求解除合同，需出具有关机构证明， 经聘方同意后，离华的费用自理;受聘方若无故解除合同，除离 华费用自理外，还应当向聘方支付违约金。 聘方因不可抗力事件要
4、求解除合同，经受聘方同意后，离华费 用由聘方负担；聘方若无故解除合，除负担受聘方离华费用外， 还应当向受聘方支付违约金。 八、本合同附件为合同不可分割的一部分，与合同具有同等效 力。 九、本合同自双方签订之日起生效，合同期满即自行失效。当 事人一方要求签订新合同，必须在合同期满 90 天前向另一方提 出，经双方协商同意后签订新合同。 受聘方合同期满后，在华逗留期间的一切费用自理。 十、仲裁 当事人双方发生合同纠纷时，尽可能通过协商或者调解解决。 若协商，调解无效，可向国家外国家局设立的外国文教专家事 务仲裁机构申请仲裁。 本合同于 年 月在 (地点)签订，一式两份，每份都中文和英文 写成，两种
5、文本同等作准。 第 4 页 聘方签字： 受聘方签字 合 同 附 件（供参考） 编号： 中学(以下简称甲方)聘请(以下简称乙方) 为外籍教师。双方本着友好合作的精神签订本合同附件，并保 证认真履行附件中的各项义务。 甲、乙双方应共同遵守国家外国专家局制定的外国文教专家 生活待遇条件中的有关条款。 1乙方在甲方工作的总学时数为课时周。主要担任课程 有 (1)英语口语教学 (2)开展英语课外活动、讲座 （3）培训本校英语教师口语 乙方参加甲方的英语教研及相关学术活动，对学生进行课外英 语辅导等不计在学时效内。 2甲方应根据不同班级的教学要求制定相应的教学内容，安排 课程表。乙方应将教学计划和教材内容
6、事先交甲方审定，并按 指定的时间和地点上课。在教学过程中，经甲方同意，乙方可 适当调整教学计划或内容。乙方根据教学需要补充的教材、资 第 5 页 料等，应经甲方同意，方可使用。当甲方对乙方进行教学评估 时，乙方应予以合作。 3甲方按月(每月 10 日)支付乙方工资，时间从 2002 年 3 月 3 日至 2002 年 6 月 30 日止。 4甲方须支付乙方(外教)在到职期间所发生的国内段机票款， 连同 50 元机场建设费和 20 元保险费。 5对任职半年的外教，甲方应提供旅游津贴 1100 元。 6甲方应负责支付乙方到职后办理各种手续，包括住宿证、居 留证和专家证及有关费用。 7乙方受聘期间，
7、甲方为其免费提供的住房及其设施(如：电 视(上网费用自理)、冰箱，洗衣机，热水器、电话(电话费自理)等) 仅供乙方专用。乙方(外教)将每月按时支付电话费和上网费。 8，乙方来客探访需投宿者，乙方应提前三天告知甲方，并由甲 方妥善安排住宿，费用自理。 9乙方受聘期间，免费享受甲方(校内)的医务室治疗。如需到 校外医院治疗，甲方半年应为乙方提供医疗费用人民币 500 元， 超出部分自理。 10休假遵循国家外专局有关规定。 本合同附件于 2002 年 3 月，在江苏省常州市田家炳实验中学三 楼会议室(地点)签定，中文和英文文本一式两份，甲，乙双 方各保留一份。两种文本具有同等法律效力。 第 6 页

The two parties, in a spirit of friendly cooperation, agree to sign this contract and pledge to fulfil conscientiously all the obligations stipulated in it. II. 11、y Bs Obligations 1. Party B shall observe the laws, decrees and relevant regulations enacted by the Chinese government and shall not interfere in China s internal affairs. 2. Party B shall observe Party As work system and regulations concerning administration of foreign experts and shall accept Part
12、y As arrangement direction, supervision and evolution in regard to his/her work. Without Party As consent Party B shall not render service elsewhere or hold concurrently and post unrelated to the work agreed on with Party A. 3. Party B shall plete the tasks agreed on schedule and guarantee the quali
13、ty of work. 4. Party B shall respect Chinas religious policy, and shall not conduct, religious activities inpatible with tile status of a teacher. 5. Party B shall respect the Chinese peoples moral standards and customs. VII. Revision, Cancellation and Termination of Contract 1. Both parties should
14、abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent. 第 8 页 2. The contract can be revised, canceled, or terminated with mutual consent. Before both parties have reached an agreement, the contract should be strictly observed. 3. Party
15、A has the right to cancel the contract with a written notice to Party B under the following conditions: (1) Party B does not fulfil the contract or does not fulfil the contract obligations according to the terms stipulated, and has failed to amend after Party A has pointed it out. (2) According to t
16、he doctors diagnosis. Party B cannot resume normal work after a continued 30 day sick here. 4. Party B has the right to cancel the contract with a written notice to Party A under the following conditions: (1) Party A has not provided Party B with necessary working and living conditions as stipulated
17、 in the contract. (2) Party A has not paid Party B as scheduled. VIII. Breach Penalty When either of the two parties fails to fulfil the 第 9 页 contract of fails to fulfil the contract obligations according to the terms stipulated, that is, break the contract, it must pay a breach penalty of US $500

If Party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain Party As consent and pay its own return expenses; If Party B cancel the contract without valid reason, it should pay its own re

If Party A asks to cancel the contract due to events beyond control, with the consent of Party B, it should pay Party Bs return expenses; if Party A cancel the contract without valid reason, it should pay Party Bs return expenses and pay a breach pe
20、nalty to Party B. IX. The appendix of this contract, is an inseparable part of the contract and has equal effect. X. This contract takes effect on the date signed by both parties and will automatically expire when the contract ends. If either of the two parties asks for a new contract, it should for

Party B shall bear all expenses incurred when staying on after the contract expires. XI. Arbitration The two parties shall consult with each other and mediate any
22、disputes which may arise about the contract. If all attempts fail, the two parties can appeal to the organization of arbitration for foreign experts affairs in the State Bureau of Foreign Experts and ask for a final arbitration. 24、 spirit of friendly cooperation, agree to sign this Appendix, which is a continuous part of the contract, and pledge to fulfill conscientiously all the obligations stipulated in it. Both parties shall abide by the terms concerned in the papers “The living Conditions of Foreign Experts Working in Cul
25、tural and Educational Institutes“. issued by the State Bureau of Foreign Experts of China. Party. B shall work for Party A 14 teaching hours per week totally. The courses that Party B should conduct are as follows: 1) To teach Spoken English in Senior Middle School. 2) To organize the outside class
26、activities and lectures. Party B is advised to take part in teaching or other related academic activities, and coach his students, if required, after class. That shall not be included in the regular teaching hours. II. Party A shall work out the outlines of the different classes and set up the sched
27、ules of the classes. Party B shall make out the syllabi for each 第 12 页 course and present them to Party. A for approval. Party B shall give lessons in the suggested classroom at the given time. When deemed advantageous, Party B may, with the consent of Party. A, adjust his or her syllabi, use self-
28、prepared materials, videocassettes or other materials. When Party A evaluates Party Bs work, Party B is advised to offer cooperation. III. Party A shall pay Party. B monthly (10th of the month), mencing from March 3th 2002 to June 30th 2002. IV. Party A shall pay Party B the expense of flight from B
29、eijing to Nanjing and 50 yuan ,which is the expense of airport construction and 20 3man, insurance. V. Party A shall pay Party B 1100 yuan as a travel allowance if Party B teaches for half a year. VI. Party A shall pay all the expenses of going through all the formalities, such as residence paper, f
30、oreign expert certificate. VII. When Party. B performs the obligations stipulated in the contract, the lodgings and other facilities provided by Party A are for Party Bs private use during his/her service in TJBEMS, such as a TV set, telephone, e-mails, refrigerator, washing machine, and 第 13 页 water-heater etc. Party B shall pay for the use of domestic and international telephone calls, fixes and e-mails for his/her private purpose. Party B shall pay the expenses of domestic and international telephone calls, fixes and e-mails etc. in time every month.
